Terms of Use

PunkinsNFT is a collection of original, hand-drawn, programmatically-generated, digital pieces of art (each a “Punkin” and collectively “Punkins”). Each Punkin is stored as an NFT, living on the Ethereum blockchain, with its metadata stored on IPFS. By accessing and using www.punkinsnft.com (including its owners, managers, representatives, and agents, the “Website”), and/or by minting a Punkin through this Website, you (the “User”) agree to comply with and to be bound by the following terms and conditions of use:

1. This Website is the only official online portal where a User can mint its own Punkin. This Website has been optimized to integrate with the Metamask Chrome browser extension, or with the Metamask mobile app via iOS. While it may be possible to mint a Punkin through the Website using a different Ethereum wallet or browser extension, User acknowledges and agrees that the Website makes no representations or warranties, express or implied, as to the abillity to mint a Punkin without using Metamask.
2. Secondary markets to purchase previously minted Punkins may be available through other third-party venues such as OpenSea. User acknowledges and agrees that the Website makes no representations or warranties, express or implied, as to the availability or authenticity of any Punkin purchased through any such other third-party venue.
3. User acknowledges and agrees that it is entirely and solely responsible for the use, maintenance, security, and privacy of its own Ethereum wallet, including the validation of any transaction or contract entered into, generated, or approved through the Website or involving any Punkin.
4. User owns each Punkin that it mints through the Website or that it purchases through a secondary market venue. The Website will not cease, repossess, or alter any Punkin after it has been minted. The Website grants each User a limited license to use each Punkin that it owns in commercial applications (such as by printing or otherwise reproducing copies of the User’s Punkins on merchandise for sale such as t-shirts or hats, by displaying the User’s Punkins on other websites or applications, or by selling or otherwise transferring the User’s Punkins through third-party marketplaces or other venues), provided that the User’s ownership and authenticity of each Punkin is cryptographically verifiable through the Ethereum network.
5. User acknowledges and agrees that the Website also retains a limited right to use any Punkin, regardless of any specific Punkin’s ownership, in commercial applications, such as by printing or otherwise reproducing copies of any Punkin on merchandise for sale such as t-shirts or hats, and to receive ongoing royalties from the sale of any Punkin through certain secondary markets or other third-party venues such as OpenSea.
6. User agrees to hold the Website completely harmless against any and all losses or damages that may occur in connection with a User’s interaction with the Website or with any Punkin in any way whatsoever.
